Refund/Cancellation Policy

This Refund/Cancellation Policy (the “Policy“) is entered into by and between The Data Company Technologies Inc. (or, if applicable, the other Nimble entity specified in the Order) (“Company,” “we,” “us,” or “our“) and the customer entity specified in the Order or any other applicable user interface embedded order flow available (“Customer” “you,” or “your“). Company and Customer may be collectively referred to herein as the “Parties” and each individually as a “Party.”

The information processed by the Company by virtue of this Policy is governed by the Company’s Terms and Conditions (“Terms”) (when applicable), available at and/or the Company’s Data Processing Agreement (“DPA”),  available at In the event of any conflict between this Policy and the Terms or the DPA, the Terms and the DPA shall prevail.

  1.    Subscriptions

(a) FREE TRIALS. You may have access to a free trial period of certain Products (“Free Trial”). You are only allowed one Free Trial regardless of your subscription method. We reserve the right to determine eligibility for Free Trials, which may vary based on factors including the Product or Service you select and whether you have redeemed a Free Trial previously. Free Trials automatically convert to a paid annual or monthly subscription term after a certain period of time. You can disable the automatic conversion by following the cancellation instructions set forth below prior to the date of conversion.

(b) AUTOMATICALLY RENEWING SUBSCRIPTIONS. You may access the Products or Services via a subscription as defined in the Terms (“Subscription”). Subscriptions may be available via monthly or annual options (“Subscription Term”). If you activate a Subscription, you authorize Company to periodically charge, on a going-forward basis all accrued sums (“Subscription Fee”) on or before the payment due date for the accrued sums. Your account might be charged automatically on the date when you purchase your first subscription to the Product or Service (“Subscription Billing Date”) for all applicable fees and taxes for the next subscription period. The Subscription will continue unless and until you cancel your Subscription or Company terminates your Subscription or your account.

(c) CANCELLATION. You may cancel your Subscription at any time, but you must cancel your Subscription before it renews in order to avoid billing of the next periodic Subscription Fee to your account. See more about cancellation below.

(d) REFUNDS. Refunds cannot be claimed for any partial Subscription Term. Company will bill the periodic Subscription Fee to the payment method you provide to us during registration (or to a different payment method if you change your payment information) (“Payment Method”). You will only have access to the Products and Services while your Subscription is active and subsisting.

  2.    Cancellation

(a) CANCELLATION BY US. We may suspend or terminate your use of the Services as a result of your fraud or breach of any obligation under the Terms. Such termination or suspension may be immediate and without notice. If we terminate your account, you may receive a pro rata refund of fees that you prepaid for the Services.

(b)  CANCELLATION BY YOU. You may cancel your Subscription at any time. Cancellation of a monthly Subscription is effective at the end of the applicable monthly period and cancellation of an annual Subscription is effective at the end of the applicable annual period. (c)  CANCELLATION FEES. Some features of the Services are subject to certain cancellation fees, as disclosed via the Services and/or the Terms. We may suspend or terminate access to the Services for any account for which any amount is due but unpaid. In addition to the amount due, a delinquent account will be charged with fees or charges that are incidental to any chargeback or collection of any unpaid amount, including collection fees.
